Prisoner Petitions – Nevada (NV)

Nevada State PrisonThe sources of habeas corpus can be found in the Constitution, statutory law, and case law. The Suspension Clause of the Constitution (Article I, Section 9, Clause 2), states: “The Privileges of the Writ of Habeas Corpus shall not be suspended unless when in Cases of Rebellion or Invasion the public Safety may require it.” Although the Constitution does not specifically create the right to habeas corpus relief, federal statutes provide federal courts with the authority to grant habits relief to state prisoners. Only Congress has the power to suspend the writ of habeas corpus, either by its own affirmative actions or through an express delegation to the Executive. The Executive does not have the independent authority to suspend the writ. More:https://www.law.cornell.edu/wex/habeas_corpus

  1. Do not let him out please he murdered my father and shot that girl he is a menace to society keep him in jail or give him the death penalty

    • I agree. The girl he shot was my best friend. She lived in fear of his family doing something to her and/or her children until the day she passed away from natural causes some years later. But either way just the fact that she was so terrified and the way that she was shot and left for dead and her friend murdered he deserves to rot in prison or get the death penalty. I dont think the small amount of time he got was justice for either family. The man who was murdered was murdered in cold blood and she was shot and he most definitely intended on killing her so there wouldnt be any witnesses. But god had other plans for her which is why i believe she survived. I will be at his parole hearing in place of my best friend to make sure he doesnt get out until he expires. Because unfortunately thats the longest they can keep him by law so he should have to stay there until then.

  2. Tuiofu is a changed man and has paid for his involvement in which he did not take a life. He has dedicated his life to God. My deepest condolences for your loss. This is not the same person he will be a great member to society and work diligently to bring hope, peace and strength to his family and community.
